Information according to D. Lgs 30.06.2003, n. 196 regarding protection of personal data
Dear Customer,
We inform you that for purposes related to the Service, dominiofaidate srl. processes the data supplied by you, or anyway, data acquired during the implementation of the Service.
The data controller is dominiofaidate srl in its legal representative pro tempore.
The list of those responsible for the processing of personal data and third party recipients of communications is available at the offices of dominiofaidate srl.

The processing of data using appropriate procedures to protect the confidentiality and consists on collection, recording, organization, storage, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, distribution, deletion, destruction of the same including the combination of two or more of the above activities.

The processing of data, in addition to purposes related, instrumental and necessary for the supply of the Service will focus on:
a)	communicate the data to companies that perform functions necessary or instrumental to our Service and / or manage databases aimed at safeguarding the credit risks and also accessible to third parties;
b)	collect data and information in general and particularly on the orientations and user preferences;  send information and offers, including third offers; send advertising and informative materials; commercial communications, also  interactive; make direct activity of sale or placement of goods or services; process studies and statistics on sales, customers and other information, and eventually communicate them to third parties; give to third parties the information collected and processed for commercial purposes, also for sale or attempted sale, or for all commercial purpose and / or  licit statistical purpose.

The conferiment of consent to the processing of personal data by user is optional. In case of refusal of treatment of personal data, referred in sub paragraph b) the treatment will be limited to the integral execution of obligations arising from the provision of the  service, as well as the fulfilment of obligations under applicable laws, regulations and legislation. In case of refusal of treatment of personal data referred to in sub paragraph a) the Company can not provide the Service.

The processing of user data for the purposes above mentioned will take place primarily through automated and computerized modality, in accordance with the rules of confidentiality and security required by law. The data will be stored for the statutory time limits at dominiofaidate srl and processed by employees and / or professionist, who carry out those activities under his direct supervision and responsibility. To this end, the data provided by the user may be transferred to third parties, even abroad, who perform functions closely related and instrumental to the operativity of our Service.

Please also be advised that, pursuant to art. 7 D. Decree Law of June 30, 2003, No 196, the customer has the right to object, in whole or in part, for legitimate reasons, to the treatment and may, in the manner and within the limits set by current legislation, require confirmation of the existence of personal data concerning him, and know the source, receive intelligible communication, obtain information about logic, methods and purposes of the processing, request updating, rectification, integration, request cancellation, transformation into anonymous form or blocking of data processed unlawfully, including those no longer needed for achieving the purposes for which they were collected, and, more generally, to exercise all the rights that are recognized by the applicable provisions of law.

TERMS OF AGREEMENT
This is the English translation of terms of agreement dominiofaidate srl. The official version is written in Italian. Make refer to the italian version.

1. SUBJECT: These general conditions have as their object  the rules applicable to the service provided and offered by dominiofaidate srl as described in www.dominiofaidate.com site. Online module transmission, acceptance of online conditions and payment are valid acceptance of the terms of contract.

2. ASSIGNMENT OF THE CODE OF IDENTIFICATION AND CONFIDENTIALITY.
Access to the service rendered by dominiofaidate srl is enabled through a user identification code (user ID) and a keyword (password), which will be communicated by dominiofaidate srl exclusively to the e-mail reference comunicated from  the user at the time of signing the contract. The user must keep the same with the utmost care, keeping them secret for the duration of the subscription. The user also will be solely responsible for any damage caused, both to himself and to dominiofaidate srl. from knowledge, use of password or UserID by third parties. The user undertakes to notify at dominiofaidate srl immediately and exclusively by fax, any theft, loss or ownership in any capacity by a third party of the password or UserID.

3. DURATION OF THE CONTRACT.
THE CONTRACT HAS A DURATION OF 12 MONTHS FROM THE DATE OF PERFECTIONING AND COMPLETION OF THE SAME. THE CONTRACT AUTOMATICALLY TERMINATE ON EXPIRY. DURING THE VALIDITY PERIOD, CUSTOMER WILL HAVE THE OPPORTUNITY TO REQUIRE THE ACTIVATION OF ADDED PACKAGES. MODE AND COSTS ARE SHOWN ON THE SITE http://www.dominiofaidate.com.
These additional services, regardless of the date of their activation, will have the same length of the domain name.

4. OWNERSHIP OF MATERIALS AND PROGRAMS LICENSED TO USER
All programs dominiofaidate srl., including media and documentation shall remain in full and exclusive property of dominiofaidate srl itself. The user can only use them for the period and in the terms covered by this contract.

5. CHARACTERISTICS AND MODALITY OF SERVICES PROVIDED BY dominiofaidate srl. INTERRUPTION OF SERVICE.
The service is normally available 24 hours every day for all the year, except for any routine maintenance or emergency maintenance that may lead to suspension; that typically does not continue for more than 24 hours.
Dominiofaidate srl should stop the service for a period exceeding that referred to above reserving the unquestionable power also because of exceptional technical reasons.
In any case dominiofaidate srl shall not be liable for any damages arising from service interruptions, no guarantee being from the same given for the continuity of the same,  as well as the integrity of data stored or sent through the system dominiofaidate srl and / or through Internet.
Technical assistance is carried out by dominiofaidate srl during the opening hours of the offices in the manner provided on the site www.dominiofaidate.com 
The hosting service offered by DominioFaiDaTe Srl is maintainance of a domain name. Depending on your choices,  you can add more ancillary services to the maintenance of a domain name, with costs determined on the basis of additional service purchased.
The Client acknowledges and accepts that for the implementation of the service is  required the use of a shared band  among different users, therefore Dominiofaidate srl reserves the right to limit the band available for each domain name and for any ancillary service, that limitation may relate to the internet band, the number of concurrent connection and the number of daily connections.
It remains a customer's task  verify his right to register a domain name to itself, both nationally and internationally, according to the law

6. REGISTRATION OF DOMAIN
dominiofaidate srl. is not responsible for the domain failure for registration,transfer, renew, it's not responable for  losing or appropriation by third parties of the requested domain
 
6.1 MAINTENANCE OF A DOMAIN NAME AFTER THE DEADLINE.
The Customer acknowledges and agrees that, without renewal (in the manner indicated in art. 3), dominiofaidate srl reserves the right at own discretion  to renew the domain’s maintenance for one or more annuities without changing the recording data. It is understood that, in this case, will be turned off all the services related to domain
(by way of example but not exhaustive: hosting, e-mail, any additional services) and will be inserted in place of the home page, a web page containing advertising messages.
The Customer will regain the availability of the domain and related services, with the terms and at conditions posted on the site http://www.dominiofaidate.com and the contract duration will always the same selected when ordering, but in any case, the first year will be equal at  the residual period until the expiration date of the domain to the Registration Authority.
In this case, the user acknowledges and accepts that dominiofaidate srl. can not guarantee the preservation of the contents of the web space, therefore, the user releases from responsibility dominiofaidate srl, now by then, from any liability direct and indirect, for any partial or total loss of data, for any partial or total loss of  informations and contents, allocated on the site corresponding to the domain name in question, at the time of  contract expires. It remains save the right of the customer to request the cancellation of the domain name at any time by giving expressed comunication to the writer.

6.2 TRANSFER OF THE DOMAIN TO OTHER PROVIDERS
In case of transfer of domain from another provider / maintainer the contract will cease its effect on the date of the conclusion of the transfer. Consequently, at  conclusion of the transfer, the website and all related services will thus be deactivated and  the relative web space deleted, remains explicitly ruled out every and any repayment by Dominiofaidate srl against the customer for the remaining period not used.

7. PROPER USE OF THE SERVICE PROVIDED BY Dominiofaidate srl.
7.1 . It's expressly excluded the possibility to transfer this contract to third parties, whether free or not, temporarily or permanently, without the written consent of dominiofaidate srl.

7.2. With reference to the web hosting service, it's expressly prohibited for the user activate software components whose installation could  affect on the operating system of server / servers of  dominiofaidate srl. It's expressly prohibited for the user activate software components whose installation could alter the registers of configuration of  the same / i, or that however interfere with the network to which the servers are connected, as well as the misuse or inexperienced of authorized components, causing instability in the property system of dominiofaidate srl. 
Executable files. exe are not allowed on the  shared hosting service. In order to prevent spamming  not use any script whose illicit use appears obvious.

7.3. The user further take note that dominiofaidate srl does not permit  the use of the service provided for:
7.3.1 spamming, that is sending unsolicited and unwanted messages, even by using mail grabbing accordance with the regulations;
7.3.2 make correspondence against morals and public order or with the purpose of causing annoyance to the public or private peace, causing offense, direct or indirect damage to third parties;
7.3.3 intercept, prevent, stop  computer and telematics communications in illicit mode and / or disclose the contents;
7.3.4 violate, subtract or abolish informative correspondence or telematic correspondence between third parties;
7.3.5 communicate over a network using an offensive, abusive and/ or libelous language
7.3.6 violate the privacy of other users;
7.3.7 contravene directly and / or indirectly to the applicable laws of the Italian state or another state.

7.4 dominiofaidate srl has the right to terminate at its sole discretion and as long as necessary for inspections, service supply, upon notice by e-mail, where it occurs instability / damage caused to the system as specified in paragraph 7.2, and its failure to the points 7.3, 7.31, 2,3, 4 ,5, 6, 7.

8. PROPER USE OF INTERNET SERVICES.
The use of Internet services toward other nodes of the Internet network not in the management of dominiofaidate srl will be subject to the limitations and responsibilities established from each operator of such services and will be conducted in compliance with the laws in force in host countries of such nodes and services, international laws and regulations of use of networks and nodes involved. (Netiquette rules governing the use of the Internet in Italy is available at http://www.nic.it/

9. WARRANTIES.
The user warrants to dominiofaidate srl that any materials possibly placed on the Internet, which could be attributable to the same in virtue of  the identification code and / or password, is genuine and that any extract of material protected by copyright, used by the user will be introduced  only with the written consent of the rightholder, with obligations for user to cite the source and the existence of the authorization, by virtue of this contract.
The user further provides guaranty that such material does not infringe or violate any copyright, trademark, patent or other rights protected by law, contract and custom.
The user notes that it is also forbidden to use or allow others to make use of dominiofaidate srl and of internet network for correspondence against morality and the public order or with the purpose of causing annoyance to the public or private peace, causing offense or damage directly or indirectly to any person and groped to violate the secrecy of private messages; in any case,

information provided by user must not present form or content that is pornographic, obscene, profane, or defamatory.
The user further acknowledge that it is forbidden to disclose information to third parties if it appears harmful to the image Dominiofaidate srl
The user further acknowledge that is prohibited using the services offered by Dominiofaidate srl  to send  to a third party advertising contents.
However, it is explicitly forbidden to make use of dominiofaidate srl and / or the Internet to contravene directly or indirectly  the current Italian laws or that of any other state.
In case of violation of  prohibitions above-mentioned,  to that end expressly recalled, the contract will be considered terminated pursuant to art. 1456 c.c., for Exclusive fact and user’s fault, dominiofaidate srl hasn’t to repay, nor in part, the amount paid by the user and without prejudice to any other action of recourse and / or indemnity  toward the responsible for violations. In any case, the user releases from responsibility and holds harmless dominiofaidate srl and / or its agents from any injury and / or damage  consequential to their unlawful activities.

10. USER OBLIGATIONS.
The user must  update the data - both personal and technical - from the same inserted  in the control panel when concluding the contract or thereafter, by pledging to give immediate notice to dominiofaidate srl of any change in them.
The customer, therefore, is responsible for the accuracy and actuality of the data provided and any consequences arising from the failure update of the same.

11. COSTS FOR THE TELEPHONE LINE
The costs of using the telephone line to connect to dominiofaidate srl and necessary equipment shall be borne by the user.

12. PAYMENT OF FEES.
Payments will be made by user as specified in the dominiofaidate website.
For services of renew of the validity of domain names, the reactivation of a deleted domain (if possible) involves the payment of  a cost of reactivation, such cost shall be indicated to the user on the site dominiofaidate.com when applying for the reactivation.
If the payment for renew service is made by wire transfer: the payment must be executed 20 days before the service expire and a payment proof must be sent to dominiofaidate as indicated in dominiofaidate website.
LATE PAYMENT AND DEFAULT INTEREST AND SUSPENSION OF THE SERVICE.
Failure to timely payment, even partial, of the compensation due to dominiofaidate srl. will produce ipso jure the termination of the contract pursuant to art. 1456 c.c. to the fault of the User resulting in data loss and cancellation of any domain, and the consequent damages compensation in addition to payment of amounts due. If dominiofaidate srl. does not make use of the right granted him by the above-mentioned  termination clause, the delay in user's payment  will result the payment of interest at a rate of 5% higher than the legal one by the user, with contextual faculty of dominiofaidate Ldt. to suspend, in any case, the supply of its service.13.

13. RESOLUTION AND EXPRESS CANCELLATION CLAUSE.
In all cases of default of its obligations under Art. 2, 7, 8, 9 and 11 of this contract, dominiofaidate srl will be entitled to terminate this contract pursuant to art. 1456 c.c., without being required to repay the amounts paid in advance by user for amounts and / or services not yet used, except,  in any case, actions to obtain compensations for further damages suffered.

14. VAT.
For the purposes to apply VAT to the contractual consideration apply the provisions of Presidential Decree 633/72 and subsequent amendments

15. TAXES.
Is charged to user every eventual cost, tax or fee concerning this contract.

16. PRICE VARIATION
dominiofaidate Inc. reserves the right to change the price of services offered by giving on-line comunication  on the site http://www.dominiofaidate.com

17. NOTICES.
All communications relating to the contract should be sent to the addresses indicated by the parties in this contract with priority to the e-mail address. The user agrees to give prompt notice of any change of address, in particular of the e-mail reference indicated when the contract is concluded.

18. USER'S WITHDRAWAL 
Under Article. 5 of Legislative Decree 185/99, user consumer, natural person acting for purposes unrelated to his  profession or other professional activities eventually executed, has the right to terminate this contract, without penalty and without specifying the reason, within 10 working days from the conclusion of this contract.
The right of withdrawal meets the limits set by the Legislative Decree no. 185/99, in particular, can not be exercised if service supply was initiated, with  the consumer's agreement, before the expiry of ten working days after the conclusion of this contract.

19. GENERAL PROVISIONS.
This contract cancels and  supersedes any previous agreement that might have intervened between the User and dominiofaidate srl. in order to the same object, and constitutes the entire agreement reached between the parties on this subject. Any modification to this contract must result on writing act, signed by the parties. Possible tolerances by one of the part of behaviours that are in violation of the provisions of this Agreement shall not constitute waiver of the rights which belong to that part under the contract.

20. OBLIGATION TO PRINT THE CONTRACT.
Under Article. 4, paragraph 1 of Legislative Decree 185/99, the User is required to print or save on computer support this contract complete with all its parts.

21. GOVERNING LAW 
The Parties agree that the provisions of this contract are governed by the laws and regulations of the Italian state.

22. PLACE OF JURISDICTION
For any dispute if the need arises will be exclusively place of jurisdiction the court of Sassari (Italy).

a) I Read the privacy policy, I express my consent to the processing and communication of my personal data to companies that perform functions necessary or instrumental to operation of the service, and I express my consent to the processing and communication of my personal data to companies charged with the protection of credit, under this contract, that could send informations to third companies, for the same purpose. In absence of my consent the service will not be supplied.
